Terms of Service

For customers

1. About Vandod

Vandod is run by VANDOD BROTHERS LLP, a limited liability partnership registered in India, with its registered office at 2593-5, CC 55, 1st Floor, Bose Nagar, Kadavanthara, Ernakulam, Kerala 682020 ("Vandod", "the LLP", "we", "us").

Vandod lets you book a professional driver who drives your own car. You might use it for a day out, a wedding, an airport run, or a one-way drive to another city. You keep your car and your plans. The driver does the driving.

Vandod is a platform that connects customers with independent, verified drivers. The drivers are independent driver partners. They are not employees of the LLP. We check them, train them, and give you the tools to book and follow a trip. The driving itself is done by the driver assigned to you.

"You" means the person using the Vandod customer app.

2. Accepting these Terms

By creating an account, continuing as a guest, or booking a trip in the app, you agree to these Terms of Service. You also agree to our Privacy Policy and our Cancellation and refund policy. They are part of these Terms. If you do not agree, please do not use the app.

These Terms are an electronic record under the Information Technology Act, 2000. They do not need a physical or digital signature.

3. Who can use Vandod

To book a trip, you need to:

  • be at least 18 years old and able to enter into a contract under Indian law;
  • be the owner of the car, or have the owner's permission to have the car driven by a driver you hire through Vandod;
  • give a mobile number that you can receive an OTP on, and keep it under your control;
  • give correct information, including your name and your car details.

Please don't let another person use your account, as you are responsible for what happens under it.

4. Your account and guest mode

You sign in with your mobile number and a one-time password (OTP) sent to it on WhatsApp. We do not use email or passwords. Please do not share your OTP with anyone.

Guest mode lets you look around the app and see how it works without signing in. In guest mode you cannot book a trip, save cars or places, or contact support about a trip. To do those things, sign in with your mobile number.

You can keep your name, your saved cars (make, model, registration number, colour, gearbox and fuel type) and your saved places in your account. Please keep them correct, because a wrong registration number or car type can delay or stop a trip.

5. What you can book

You can book two kinds of trip:

  • Round trip: the driver takes you to your destination and back to where you started.
  • One way: the driver takes you to your destination. The driver then has to travel back on their own, and a return charge covers that (see section 6).

You choose the trip type, the pickup, the drop, any stops the app allows, your car, and how long you need the driver. The app shows the fare details before you confirm.

6. Fares and billing

Before you confirm a booking, the app shows the rates that apply. Please read them. The app always shows the current rates. This page does not list them, because they can change.

  • The fare is based on the actual time the driver drives for you, from the moment the trip starts to the moment it ends.
  • There is a minimum booking time. The package price covers that minimum. If the trip takes longer, you pay an extra hourly charge for the additional time. Both are shown in the app.
  • The app may allow a short grace period before an extra hour starts. The current grace period is shown in the app.
  • On one-way trips a return charge is added for the driver's journey back. It is worked out per kilometre. The app shows an estimate before you book, using the distance between the pickup and the drop. When the trip ends, the charge is recalculated from the distance actually driven, using the driver's location during the trip, so the final amount can be higher or lower than the estimate. We limit it to a reasonable amount above the estimate, and if the location record is not usable we charge the estimate.
  • Tolls, parking, fuel, charging, and any entry fees are not part of the fare unless the app says so. You pay these yourself.
  • When the trip ends, the app shows you the final amount. It can be higher than your first estimate if the trip took more time or went further than planned.

We may change our rates from time to time. A change does not affect a trip you have already booked.

7. How a trip is assigned

Our team assigns a driver to your booking by hand. We try to find a driver quickly, but we cannot promise that a driver will be free at the time you want.

While we look, your trip shows as "Finding your driver". Once a driver is assigned, you can see their name and phone number in the app. You can follow the driver on the map on their way to you and during the trip.

If we can't find a driver, we're sorry: the booking does not go ahead and you pay nothing.

8. Start PIN and handover photo

Every trip starts the same way, which protects you and the driver.

  1. The driver arrives at your pickup point. The app shows "Driver at pickup".
  2. The driver takes a photo of your car's odometer (its kilometre reading) at handover. Only Vandod admins can see this photo. We keep it so we can settle disputes.
  3. You give the driver the start PIN shown in your app. The trip starts only when the driver enters the PIN you gave.

Please give the PIN only to the driver assigned to you, when you are ready to hand over the car. If anyone else asks for it, please don't share it, and let us know.

9. How a trip ends

A trip ends in one of two ways. It ends when the driver reaches the drop location, which the app checks by location (within 2 km of it). Or it ends when you confirm the end of the trip in the app.

When a trip ends, the time driven is fixed and the final amount is shown. If you think the end time or the amount is wrong, please let us know through Help as soon as you can (see section 13).

10. Location and route recording

During a trip, the driver's phone records the route while the driver's app is open. We keep the route as a record for safety and disputes. This is described in the Privacy Policy.

The app may ask for your own location so you can set a pickup or find places nearby. You can say no and type an address instead.

11. Your responsibilities

When you book a driver, you agree that:

  • the car has a valid registration certificate, valid insurance, a valid pollution certificate and any other document the law requires, and these are kept in the car;
  • the car is roadworthy and safe to drive, with enough fuel or charge for the trip;
  • you will not put any illegal, dangerous or prohibited item in the car;
  • you will not ask the driver to break traffic laws, drive unsafely, drive when too tired, use the phone while driving, or go somewhere unsafe;
  • you will treat the driver with respect, and will not harass, threaten, abuse or discriminate against them;
  • you will take your valuables out of the car, or accept that anything left in it is at your own risk;
  • you are responsible for the behaviour of your passengers, and for the number of people in the car being within the legal limit;
  • you will give the driver correct directions and the true pickup and drop places.

After a trip you and the driver can each rate the other. Ratings and comments are private: only Vandod admins can see them, and the other person cannot. We use them to look at service quality, and a low average rating may lead us to review an account. We do not promise any specific action.

12. Payment

Vandod does not take payment from you in the app. You pay the driver directly at the end of the trip, by UPI or in cash.

  1. The trip ends and the app shows the final amount.
  2. You pay the driver by UPI or in cash.
  3. You tap "I paid" in the app.
  4. The driver confirms that they received the money.

Please pay only the amount shown in the app, plus any toll or parking you agreed to. If a driver asks for more, please don't pay it, and tell us through Help.

You do not pay Vandod anything on top of the fare.

If a trip is left unpaid, we will get in touch with you, and we may need to pause your account until it is settled.

13. Cancellation, disputes and help

You can cancel a booking from the app at no cost until the trip starts. The details are in our Cancellation and refund policy.

If something goes wrong with a trip, such as the fare, the driver's behaviour, damage to the car, a lost item or a safety concern, use the Help section:

  1. Open Help in the app and select the trip.
  2. Choose the topic and describe what happened. You can add photos.
  3. Our team looks at the trip record. This can include the start and end times, the handover photos and the route. We may speak to you and to the driver.
  4. We reply in the app. You can see the status of your request there.

We will try to help you and the driver reach a fair result. Please report any damage or lost item within 3 days of the trip, through Help in the app or the support number. We're sorry, but after 3 days we may not be able to check what happened or help with the claim.

You can also send us general feedback or report a problem with the app through the same Help section.

14. Safety

If you feel unsafe during a trip, ask the driver to stop somewhere safe, and call the emergency number 112 if you need urgent help. You can then use the support number or the Help section to tell us. We treat safety concerns first.

15. Vandod's role and limit on our liability

Vandod provides the platform that connects you with independent drivers. The driver is responsible for how they drive. We are responsible for running the app with reasonable care, and for checking and training drivers as described in the app.

To the extent the law allows:

  • we do not promise that the app will always work without breaks or errors;
  • we do not promise that a driver will always be available;
  • we are not responsible for fines, challans or tolls caused by a driver's conduct; we will help you take these up with the driver;
  • we are not responsible for items you leave in the car;
  • we are not responsible for a loss that could not reasonably have been expected when the trip was booked;
  • our total liability to you for a trip is limited to the fare of that trip.

Damage to your car: Vandod does not insure your car or the trip, and does not pay for damage to your car, to another vehicle or to property during a trip. Your own motor insurance is the main cover for this, so please keep it valid. If the damage was caused by the driver's negligence or by the driver breaking traffic rules, the driver is responsible to you for it. We will share the trip record (times, handover photo and route) with you, the driver and your insurer when asked, and help you take the claim up with the driver.

Nothing in these Terms takes away a right you have under the Consumer Protection Act, 2019 or any other law that cannot be limited by agreement. Nothing in these Terms limits liability for fraud, or for death or personal injury caused by our negligence.

16. Using the app properly

We ask you not to:

  • give false information, or pretend to be someone else;
  • make false bookings, or false complaints;
  • misuse the OTP, the PIN or the trip tracking;
  • try to break into, disturb or copy the app or our systems;
  • contact drivers through Vandod for reasons that have nothing to do with a trip;
  • use the app for anything illegal.

17. Suspension and ending your account

We may need to suspend or close your account if you break these Terms, behave abusively or unsafely towards a driver or our team, give false information, leave a trip unpaid, misuse the app, or if the law requires it. Where we can, we will tell you why.

You are free to stop using Vandod at any time. If you would like your account deleted, please see the next section.

18. Deleting your account

You can ask us to delete your account in the app: Account > Privacy and data > Delete account. You can also make a request on the delete account page of our website.

  • There is a 30 day grace period. If you sign in again during this time and choose "Keep my account", the request is cancelled.
  • After 30 days, your account and personal details are removed.
  • Trips, payments and routes are kept as business records without your name or account link. We need them for accounts, disputes, tax and legal obligations.
  • Deletion cannot go ahead while you have a trip that is not finished, or a payment that is open.

The Privacy Policy has the full detail on what is deleted and what is kept.

19. Intellectual property

The Vandod name, logo, app, designs and content belong to the LLP or its licensors. You may use the app for your own personal use, as these Terms allow. We ask you not to copy it, reverse-engineer it, scrape it, or use it to build a competing service.

Thank you for any feedback or suggestions you send. We may use them to improve Vandod without paying you or naming you.

20. Notifications

We send push notifications about your trip and account, such as when a driver is assigned or a trip ends. In the notification settings of the app you can choose which optional categories you get; offers are off unless you turn them on. You can also turn notifications off in your phone settings, but then you may miss things about your trip. Notices about a trip or your account are needed for the service to work.

21. Changes to these Terms

We may update these Terms from time to time. If we make an important change, we will tell you in the app before it takes effect. If you keep using Vandod after the change, you accept the new Terms. The date at the top shows when the Terms were last updated.

22. General

  • If any part of these Terms is found to be invalid, the rest stays in force.
  • If we do not enforce a right straight away, we do not lose it.
  • You may not transfer your rights under these Terms to anyone else. We may transfer ours if the business is taken over, and we will keep your data protected as our Privacy Policy says.
  • These Terms, the Privacy Policy and the Cancellation and refund policy together make up the whole agreement between you and us about the app.

23. Governing law and courts

These Terms are governed by the laws of India. The courts at Kochi, Kerala have exclusive jurisdiction over any dispute, without affecting any right you may have to approach a consumer forum under the Consumer Protection Act, 2019.

Please tell us about a problem first. Most problems are solved quickly through Help.
